The U.S. Environmental Protection Agency (EPA) stated last week that it would issue a final rule on the definition of “Waters of the United States” (WOTUS) before Sept. 1.
Following the Supreme Court ruling in May, the agency motioned for a stay in a case against 24 plaintiff states and 18 trade associations, while the definition of “Waters of the United States” (WOTUS) is finalized. The U.S. District Court in North Dakota previously granted an injunction in April.
The agencies believe a stay would help conserve all parties’ resources as well as give “time to assess the new rule and determine whether to continue to litigate this case,” the motion said.
